Terms of service

These terms govern your use of zoriqena.com and any purchase you make through it. The store is operated by WAYGO TRADING DEVELOPMENT LIMITED, a company registered in Hong Kong, trading as Zoriqena. In these terms, "we", "us" and "our" mean that company; "you" means the person using the site or placing an order.

By using the site or placing an order you accept these terms. If you do not accept them, please do not use the site.

Who can buy

You must be at least the age of majority where you live, or have the consent of a parent or guardian, to place an order. You must give us accurate information when you order — in particular a delivery address that is correct and an email address you actually read, because that is where we send everything about your order.

Products and descriptions

Everything we sell is woven from reclaimed cotton offcut yarn. That material is not uniform, and we describe it honestly on the Care & Materials page: expect slubs, colour that moves across a piece, flecks of other colours in the undyed natural, and small differences between the item you receive and the photograph on the site. These are properties of the material, not defects.

Dimensions and weights given on product pages are nominal and are measured before the first wash. Woven cotton shrinks slightly the first time it is washed. Colours on your screen will not match the physical item exactly, because no two displays are calibrated the same way.

We may change products, prices and the range we offer at any time. A change never affects an order we have already accepted.

Prices and payment

All prices are shown in United States dollars and exclude shipping, which is added at checkout. Shipping is $7.95 for any order delivered within the United States and $18.95 for any order delivered elsewhere, per order regardless of how many items it contains.

Payment is taken at checkout through Shopify's hosted checkout. We do not receive or store your full card details. Our Payment & Security page sets out exactly what we can and cannot see.

We try hard to keep prices accurate. If an obvious pricing error appears on the site — a figure that is clearly wrong rather than merely low — we may cancel any affected order and refund it in full rather than fulfil it at that price. We will tell you before we do that, and you will not be charged.

Orders

Your order is an offer to buy. A contract is formed when we send you an email confirming that the order has shipped, not when you place it and not when the payment is authorised. Until then we may decline or cancel an order — for example if an item is out of stock, if we cannot ship to your address, or if the order appears fraudulent. If we cancel, we refund in full.

Delivery, duties and taxes

Orders leave us within two business days. Delivery is typically 5 to 8 business days within the United States and 10 to 20 business days elsewhere, depending on customs. These are estimates, not guarantees, and we have no control over a parcel once it is with a carrier.

Risk in the goods passes to you on delivery. If a parcel is lost or damaged in transit, tell us and we will deal with the carrier; do not wait for the return window to close.

For international orders, import duties, customs charges and local sales taxes are not included in the price and are your responsibility. They are charged by your own country, not by us, and we cannot estimate them for you. If a parcel is refused at customs and returned to us, we will refund the price of the goods less any costs we incur.

Returns

Returns and refunds are governed by our Return and refund policy, which forms part of these terms. In summary: 30 days from delivery, unused and unwashed, with return postage yours unless the item is faulty or we sent the wrong thing.

Using the site

You may use this site to browse, to place orders and to contact us. You may not use it to do anything unlawful, to attempt to gain unauthorised access to any part of it, to interfere with its operation, to scrape it systematically, or to resell or redistribute its content.

If you create an account you are responsible for keeping your password to yourself and for anything done through your account.

Our content

The text, photographs, product imagery, page designs and the Zoriqena name on this site are ours, or are used with permission, and are protected by copyright and trade mark law. You may not copy, reproduce or use them commercially without our written permission. You are welcome to link to any page on the site.

Anything you send us

If you send us a photograph, a review, a suggestion or any other material, you give us permission to use it in connection with the business — for example to help another customer with the same question, or to improve a product. You confirm that it is yours to give. We do not have to use it, and we do not have to keep it.

Liability

We provide the site as it is. We do not warrant that it will be uninterrupted, error-free or free of anything harmful, though we take reasonable care.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, or loss arising from your use of the site. Where we are liable, our total liability in respect of any order is limited to the amount you paid for that order.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, nothing here removes your statutory rights under the law of your own country.

Events outside our control

We are not liable for a delay or failure to perform caused by something outside our reasonable control — including carrier failure, customs action, industrial action, natural events, or the interruption of manufacturing or transport. If such an event continues for more than 30 days you may cancel an undelivered order for a full refund.

Governing law

These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have jurisdiction over any dispute. If you are a consumer resident elsewhere, this does not deprive you of the protection of the mandatory consumer law of the country where you live, or of the right to bring proceedings there where your local law gives you that right.

Changes to these terms

We may update these terms. The version in force when you place an order is the version that applies to it. Changes are published on this page with a new date at the top.
